JUSTICE SANJAY PRIYA ORAL ORDER 3/ 17-01-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The Petitioners seek bail in Nokha P.S. Case No.224 of 2016 instituted for the offence under Section(s) 419, 420, 379, 120-B Indian Penal Code.

It is alleged that the petitioners, who are the father and son, received Rs.490/- from the residents of village- Parwa for construction of latrine from government fund under Nokha Block and collected a sum of Rs.30,000/-. The Informant on getting information visited the village-Sisrita on 23.09.2016, where several villagers filed petition against the alleged act. The petitioners admitted that they were doing this work on the instruction of Babudhan Singh, Sanjay Kumar Singh and Upendra

It has been submitted on behalf of the petitioners that they are in custody since 24.09.2016. The learned Sessions Judge has mentioned in the impugned order that witnesses in para 17 and 19 have supported the occurrence. There is no mention in the written report that any amount was recovered from the possession of the petitioners.

Keeping in view the period of custody and the nature of allegation, let the Petitioners, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the ACJM-5, Sasaram, in connection with Nokha P.S. Case No.224 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioners.
