JUSTICE ARUN KUMAR ORAL ORDER 04-05-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Mansurchak P.S.Case No. 86 of 2017 registered under Sections 379 and 411 of the Indian penal Code. Allegation in brief is that in the night, petitioner, after breaking the lock of the cash box of the informant, a tea seller, committed theft of sale proceeds Rs. 630/- and seeing the informant, started running away but apprehended after chase by the informant and local people.
Submission is that petitioner is in custody since 22.12.2017 and has no criminal antecedent and merely on suspicion he was apprehended by the informant. Having considered the aforesaid facts and circumstances, the petitioner, namely, Mukesh Kumar @ Mukesh Jha, is directed to be released on bail upon furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.14546 of 2018(4) dt.04-05-2018 2/2 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Chuief Judicial Magistrate, Begusarai in connection with Mansurchak P.S. Case No. 86 of 2017.
