In this case, the petitioner is seeking anticipatory bail in connection with Rajpur P.S. Case No.306 of 2018, registered for the offence punishable under Sections 147, 148, 149, 332, 188, 341, 323, 307, 353, 506 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation has been made that a lady introducing herself as Dipak Devi, Mukhiya of Barupur Panchayat (the present petitioner) has gone to the police station and told the Officer-in-charge of the police station to release her father-inlaw, otherwise, road would be blocked. After some time, entire road was blocked by brining tractor and trailer.
Patna High Court CR. MISC. No.37266 of 2019(2) dt.03-07-2019 2/2 Earlier, the petitioner moved before this Court, but she withdrew her application after full fledged argument of learned lawyer at the relevant time.
Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
