The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 498A of the IPC 3⁄4 of the Dowry Prohibition Act.

As per prosecution case, it is a case of dowry death due to non-fulfillment of the dowry death. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is father-in-law of the deceased and due to which he has falsely been implicated in this case. The petitioner has no concern mess and business of the deceased as well her husband and living separately from them. It is further

Patna High Court CR. MISC. No.43682 of 2023(2) dt.21-07-2023 2/2 submitted that husband of the deceased has already been granted bail by learned Court below vide order dated 22.03.2021 passed in B.P. No. 434 of 2021. The petitioner is languishing in judicial custody since 27.04.2023. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Lakhisarai (Mahila) P.S. Case No. 05 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Lakhisarai.
