The petitioner is apprehending his arrest in connection with R.PF. Ara Case No. 614/2013 for the offences instituted under Section 160(B) of the Railway Act.

The prosecution story, in brief, is that the petitioner being the driver of the bus dashed the boom of railway gate and broken the boom of such railway gate and fled away. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner has been made accused in the present case due to mistake of fact. It is further submitted that at the instance of the petitioner life of the many other persons is said to have been

Patna High Court Cr.Misc. No.27328 of 2015 (3) dt.09-09-2015 2/2 saved. Other co-accused has been granted bail vide Cr. Misc. No. 41564/2014.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with R.P.F. Ara Case No. 614/2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Bhojpur at Ara, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
