Petitioner, already in custody, seeks bail in connection with Ghoghardiha PS Case No.47 of 2017, registered under Sections 304(B)/34 of the Indian Penal Code.

Allegation in brief is that case was instituted against the husband of the deceased and other family members for killing her on account of non-fulfillment of dowry demand. Learned counsel for the petitioner submits that the petitioner is not named in the FIR, police has submitted chargesheet under Sections 304(B) and 302 of the Indian Penal Code and only material against the petitioner is his confessional statement though this petitioner has had no motive for

Patna High Court Cr.Misc. No.14642 of 2018(3) dt.04-05-2018 2/2 committing the offence.

Having considered that except confessional statement of the petitioner, there is no other material against him, so petitioner Raushan Kumar Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Jhanjharpur in connection with Ghoghardiha PS Case No.47 of 2017.
