JUSTICE BIRENDRA KUMAR ORAL ORDER 08-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Four liters of liquor was allegedly recovered from the possession of this petitioner. The petitioner has stated on oath that he has got no criminal antecedent.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class,

Patna High Court Cr.Misc. No.22097 of 2017 (2) dt.08-05-2017 Purnea/Successor Court, in connection with Special Excise Case No.221 of 2017 (arising out of Tikapatti P.S. Case No.23 of 2017), with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
