JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 1233 of 2010 for the offences instituted under Sections 498(A), 323, 494 of the IPC and 3⁄4 of the D. P.Act. Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that the complainant was married with the petitioner. After marriage, the accused persons started demanding Rs. 50,000/- and a motorcycle as dowry and on non-fulfilment of the same the accused persons tortured the complainant.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.28825 of 2015 (2) dt.23-07-2015 2/2 petitioner is ready to live with the complainant but the complainant is in habit of instituting similar cases in respect to similar offence. Earlier also she had filed a case with the similar offence and this is a second complaint which has been instituted by her against the petitioner.
On behalf of the State it has been submitted that the petitioner is named in the complaint case.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 1233 of 2010, corresponding to Trial No. 1213 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Saran at Chapra, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
