The petitioners seek regular bail in connection with Minapur P.S. Case No. 186 of 2017 for the offence punishable under Section(s) 356 and 379 of the Code of Criminal Procedure. The case of the prosecution is that when the informant was returning from Ruinisaidpur, he was attacked by four unknown persons and the bag containing money and other articles was snatched.
The petitioner is said to be impleaded in one another case bearing Ahiyapur P.S. Case No.566 of 2017 and after he was arrested in the said case, he was remanded in the present case. It is thus submitted that apparently this case is a case of false implication. It is further submitted that there is no material on record to connect the petitioner with the alleged crime and the
Patna High Court Cr.Misc. No.28366 of 2018 (3) dt.21-05-2018 2/2 petitioner is languishing in custody since 22.12.2017. It is further submitted that apart from the aforesaid Ahiyapur P.S. Case No.566 of 2017, the petitioner is having a fair antecedent. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No.186 of 2017.
