Public Prosecutor for the State assisted by learned counsel for the informant.

Petitioners seek bail in a case registered under sections 302, 363, 376(D) and 201/34 of the Indian Penal Code and section 4 of the POCSO Act.

Petitioners are not named in the first information report and their names came in this case in the confessional statement of FIR named accused Jitendra Kumar Yadav. Subsequently, Krishan Mohan Yadav was arrested and the aforesaid co-accused, too, made his confessional statement disclosing the names of the petitioners. It appears that except the aforesaid material, there is nothing against the petitioners against whom charge sheet has already been

Moreover, co-accused Sanjeev Kumar Yadav and Krishan Mohan Yadav have already been granted privilege of bail by this court.
