The petitioners apprehend their arrest in connection with Kako P.S. Case No. 152/2003 dated 16.08.2003 instituted for the offences under Sections 147, 149, 323, 325, 337, 307 of the Indian Penal Code and later on Section 302 of the Indian Penal Code is added. Learned counsel for the petitioners submits that, as apparent from First Information Report itself, coaccused Fagu Yadav and Sattendra Yadav assaulted the
Patna High Court Cr.Misc. No.41569 of 2014 (2) dt.10-04-2015 deceased who died subsequently in course of treatment. Upon investigation, police submitted final form, but learned Magistrate differing has now taken cognizance. It was also pointed out that so far as Fagu Yadav and Sattendra Yadav are concerned, they have been trialed for the offence, but they have been acquitted by the trial court by judgment and order dated 01.12.2010. Be that as it may, in the event of their arrest/surrender before the court below within four weeks, let the above-named petitioners namely, Tila Devi, Kanti Devi, Uday Yadav and Shailesh Yadav @ Jilevi Yadav @ Shailesh Kumar, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad, in connection with Kako P.S. Case No. 152/2003 in G.R. No. 1510/2003, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Navaniti Prasad Singh, J.) Rajeev/- U T
