JUSTICE SUDHIR SINGH ORAL ORDER 24-05-2017 Learned counsel for the petitioner is permitted to make correction in para 1 of the petition in course of the day. Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 399, 402 of the I.P.C. and Sections 25(1b)a/26/35 of the Arms Act. Allegation is that one mobile was recovered from the possession of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.1.2017 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The arms is said to have
Patna High Court Cr.Misc. No.23439 of 2017 (2) dt.24-05-2017 2/2 been recovered from the possession of other co-accused. There is no recovery of fire arms from the possession of the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. case No.15 of 2017 corresponding to G.R. No.42 of 2017.
