27-10-2016 Heard Sri Anil Kumar Singh, learned counsel for the petitioner and Sri Chaubey Jawahar, learned APP. The sole petitioner, who is in custody only since 03-06-2016, has prayed for grant of bail in Nawanagar P.S. Case No. 107 of 2013 registered for offence under Sections 25(1-AA), 25(1-b)a, 26, 35 of the Arms Act, 1959 and Sections 10, 13, 19, 20 of Unlawful Activities (Prevention) Act, 1967. In this case, F.I.R. was lodged against three accused persons, including the petitioner, however; out of three, two accused persons have already been granted bail, which fact has been stated in paragraph - 14 of the present petition. Learned counsel for the petitioner submits that petitioner was resident of a different village, whereas, seizure was conducted in a village of accused Hira Lal Singh and Ran Vijay
Patna High Court Cr.Misc. No.45747 of 2016 (2) dt.27-10-2016 2/2 Singh. On aforesaid ground, a prayer has been made for granting bail to the petitioner.
Besides hearing, I have also perused the materials available on record. On going through the materials on record, it is evident that F.I.R. was lodged on 09-05-2013, in which petitioner was arrayed as one of the accused for serious offences. On perusal of paragraph - 3 of the petition, it is evident that petitioner is accused in number of cases. It is evident that petitioner remained absconding and he did not surrender, but he was arrested by the police in the year 2016. So far as grant of bail to other two accused persons is concerned, one of the accused Hira Lal Singh was granted bail on 22-10-2014, whereas another accused Ran Vijay Singh was granted bail on 03-03-2015, which fact has been stated in paragraph - 14 of the petition.
Keeping in view nature of accusation, criminal antecedent of the petitioner as well as the fact that petitioner remained absconding for a long period, there is no reason to grant bail.
Dismissed.
