Petitioners are languishing in custody for the offences punishable under Section 414 of the Indian Penal Code and Section 38(1)(2) of the Bihar Excise (Amendment) Act, 2016. Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioners and the petitioners have falsely been implicated in this case. Petitioners have no criminal antecedent and they are in custody since 07.03.2017.
Considering the aforesaid facts as well as the period of incarceration, let petitioners, above named, be enlarged on bail
Patna High Court Cr.Misc. No.22790 of 2017 (2) dt.19-05-2017 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Birpur (Supaul) in connection with Birpur P.S. Case No.32 of 2017.
