JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 29-04-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Petitioner apprehends his arrest in Kahalgaon P.S. Case No.374 of 2019 of 2017, registered for the offences punishable under Sections 341, 323, 307, 326, 504 and 34 of the Indian Penal Code.

The petitioner along with another co-accused person assaulted the informant by means of iron rod causing injuries to the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioners have got no criminal antecedent as stated in paragraph 3 of the bail application. From perusal of the injury report (Annexure-2), it

It is further submitted that the occurrence took place on 14.06.2019 and the FIR was lodged on 18.06.2019 after delay of four days. The learned APP for the State opposes the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts that there is delay in lodging the FIR and the injuries are simple in nature, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon P.S. Case No.374 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
