The petitioners seek bail in Gamhariya P.S. case No. 128 of 2016 under Section 392, 34 of the Indian Penal Code. The informant alleged that while he was returning from Sirsia Jagran Mela, three persons came on a motor cycle and snatched his mobile having SIM card No. 7763883503, Rs. 1250/- and a chain made of silver.

The learned counsel for the petitioners submits that the informant disclosed that he saw registration No. of the motor cycle as 8841 on which the three accused persons came but during the course of investigation the spy and Chowkidar disclosed that

Petitioner No.1, Gautam Kumar, is son-in-law of Kailash Yadav and petitioner No.4, Ranjeet Kumar, is son of Kailash Yadav. On such, the accused persons were arrested and motor cycle bearing registration No. BR 43E 8841 was recovered. One mobile was also recovered but the same was not put in T.I. parade. The informant filed compromise petition that the petitioners are his neighbours Considering the facts aforesaid and the fact that petitioners are in jail since 13.10.2016 and they have got no criminal antecedent, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIV, Madhepura in Gamhariya P.S.
