The petitioner seeks bail in Laukahi P.S. Case No. 204 of 2016 registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code.

The FIR was lodged against unknown for theft of different electronic articles from the shop of the informant. Learned counsel for the petitioner submits that the name of the petitioner figured in the confessional statement of Ajay Kumar Chaudhary @ Ajay Kumar Jaiswal but, nothing has been recovered from the possession of the petitioner. The petitioner is in jail since 23.12.2016. Other accused persons have been granted bail.

It appears that the mobile was recovered from Ajay

Patna High Court Cr.Misc. No.22341 of 2017 (2) dt.19-05-2017 2/2 Kumar Chaudhary @ Ajay Kumar Jaiswal who disclosed that he purchased the same from the petitioner and the said mobile is found to be stolen one. Save and except this fact, the investigating officer did not collect any further material. Considering the facts aforesaid and the fact that the petitioner is in jail since 23.12.2016, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Jahnjharpur, Madhubani in Laukahi P.S.
