Petitioner apprehends his arrest in a case in connection with Sakatpur P.S. Case No. 01 of 2014 under Section 406 and other Sections of the I.P.C. and 138 of the N.I. Act. It is alleged that Raj Mani came alongwith Deo Kant Jha the petitioner and persuaded different land owners to deposit security money for installation of mobile tower. Different persons deposited money in the account but neither money was paid nor mobile tower was installed.

It is submitted that the petitioner is also one of the victims and he deposited Rs. 85,000/- in the account of Raj Mani. Raj Mani issued a cheque of S.B.I. of Rs. 85,000/- but the same was not honoured.

No.50144 of 2014 (2) dt.10-04-2015 2 / 2 It appears that no body has given money to the petitioner and he simply accompanied Raj Mani who received money on behalf of the Company from different persons. On the other hand, learned Additional P.P. opposed the prayer for anticipatory bail.

Considering the facts aforesaid, the petitioner above named, is directed to be released on bail, in the event of his arrest or surrender before the learned Court below within four weeks from the date of receipt/production of a copy of the order on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga, in connection with Sakatpur P.S. Case No. 01 of 2014(G.R. No. 111 of 2014), subject to the conditions as laid down under Section 438(2) Cr. P.C.
