JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 The petitioner is apprehending his arrest in connection with Govindganj P.S. Case No. 74 of 2015 for the offences instituted under Sections 20 and 22 of the N.D.P.S. Act. Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that on search by the police, from possession of co-accused Naresh Ram and Ashok Ram, one Kilo Ganja, two mobile phones and cash Rs. 1580 were recovered. They also disclosed the name of this petitioner. It has been submitted on behalf of the petitioner that from possession of the co-accused about One Kg. of Ganja was recovered which was much less than the commercial amount. The
Patna High Court Cr.Misc. No.27377 of 2015 (2) dt.22-07-2015 2/2 name of the petitioner has come on the basis of confession of coaccused. There is no recovery of any contraband substance from possession of the petitioner. It is further submitted that the petitioner has got no criminal antecedent.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Govindganj P.S. Case No. 74/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran at Motihari, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
