JUSTICE RAVI RANJAN ORAL ORDER 10-04-2015 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offences punishable under sections 409, 420, 467 and 471 of the Indian Penal Code.

It is alleged that on 20.05.2014 as sum of Rs. 30,000/- was withdrawn and a sum of Rs. 75,000/- was withdrawn on 30.05.2014 from Sardiha Branch, State Bank of India, whereas there was no cheque issued for that. The amount was shown to have been withdrawn using the user ID of the petitioner. The petitioner was directed to show-cause and he admitted in his reply that from his user ID a sum of Rs. 4,55,000/- was withdrawn from 07.03.2014 to 30.05.204, however, those amounts were again deposited in the concerned accounts from which the withdrawal of

Patna High Court Cr.Misc. No.45072 of 2014 (3) dt.10-04-2015 the amount was made using his user ID.

Learned counsel for the petitioner submits that since the entire amount has already been deposited by the petitioner, he may be given privilege of anticipatory bail.

Having regard to the facts and circumstances of the case, let the abovenamed petitioner, namely, Abinash Chanchal, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Simri Bakhatiarpur Police Station Case No. 207/2014 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure. Further, if the petitioner is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
