JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 28.07.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Giriak (Katrisarai) P. S. case no. 91/2015 registered under section 307 and other allied sections of the Indian Penal Code. Petitioner no.1 happens to be full brother of the informant and petitioner no.2 is son of petitioner no.1. Although there is allegation that petitioner no.1 gave garasa blow causing head injury to the informant but annexure 3 to this petition reveals that informant sustained one lacerated wound on right side forehead above right eye brow and injuries found on the person of the informant had been caused by hard and blunt substance and simple in nature. Moreover, there is counter case also.

Patna High Court Cr.Misc. No.28039 of 2015 (2) dt.28-07-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Sri K.K. Shahi, Judicial Magistrate, Ist Class, Nalanda at Biharsharif/concerned court in Giriak (Katrisarai) P. S. case no. 91/2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
