====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Rail Darbhanga (Sitamarhi) P.S. Case No. 85 of 2016, registered under Section 370 of the Indian Penal Code and Section 16 of he Bonded Labour System, Abolition Act, 1976.

The accusation is that on receiving secret information about carrying the children as bonded labourers, petitioner and nine others were apprehended at the Railway Station, Bargainiya with 28 children, below the age of 18 years. One child, namely, Chunchun Kumar, was found with the petitioner and on query he did not give proper reply about keeping Chunchun Kumar.

No.23155 of 2017 (2) dt.17-05-2017 Learned counsel for the petitioner submits that, in fact, the petitioner was present at the railway station for going to Mumbai but he was apprehended by the police mere on suspicion. It is further submitted that petitioner has no criminal antecedent and is in custody since 21.10.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Railway, Samastipur, in connection with Rail Darbhanga (Sitamarhi) P.S. Case No. 85 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
