JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-09-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceedings. Learned counsel for the petitioner undertakes to remove the defects as pointed out by the office within four weeks of normal functioning of the court, failing which the office is directed to place the matter before the Bench. The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Vide order dated 10.02.2021, prayer for bail of the petitioner was allowed in Cr. Misc. No.39774/2020 with a direction to the learned court below to verify the criminal antecedent of the petitioner. After verification, the learned court below has found that petitioner has one criminal antecedent, therefore, bail bond of the petitioner has not been accepted.

Patna High Court CR. MISC. No.50788 of 2021(2) dt.08-09-2021 2/2 Thereafter, the petitioner filed the modification application for modifying the criminal antecedent, which was also dismissed by this Court.

Learned counsel for the petitioner submits that the petitioner has one criminal antecedent as stated in para 3 of the bail application.

Considering the aforesaid facts and circumstances of the case and the fact that the petitioner has already been granted bail in Cr. Misc. No.39774/2020, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Aurai P.S. Case No. 101/2020 to the satisfaction of learned Court below where the case is pending/ successor Court.
