This is a petition for grant of regular bail for offence under Sections 302, 201 and 34 of the Indian Penal Code. Rinki Kumari, the daughter of the informant was married with the petitioner about more than ten years prior to her death. She was mother of two sons, aged about 10 years and 1 year respectively.
Allegation is that the petitioner has got criminal antecedent and he might have committed murder of the deceased. Submission of the petitioner is that there is false implication just to pressurize.
Learned counsel for the informant submits that the doctor before whom the victim was allegedly carried for treatment by the petitioner has not supported the fact before the police that the victim was suffering from heart ailment, as claimed by the petitioner. He, further, submits that the dead body was disposed of without post mortem, hence, strong suspicion is there against the petitioner.
Considering the fact that only suspicion is there against the petitioner, above named, and the petitioner is in jail
Patna High Court Cr.Misc. No.46337 of 2016 (3) dt.19-12-2016 since 01.04.2016, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Kankarbagh P.S. Case No. 808 of 2015 to the satisfaction of Miss Kaniprachala Anjale, Judicial Magistrate, 1st Class, Patna, or successor Court.
