The petitioner seeks bail in connection with Govindpur P. S. Case No. 174 of 2020 dated 23.08.2020, instituted for offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. A Bolero vehicle was intercepted, from where 739.500 litres of liquor was recovered. The owner of the vehicle also has been made accused in this case. The petitioner was allegedly found travelling in the said vehicle.

The learned counsel for the petitioner has

Patna High Court CR. MISC. No.37754 of 2020(2) dt.05-02-2021 2/2 submitted that he is neither the owner nor the driver of the vehicle; rather he was only a gratuitous passenger who has been made accused in this case.

He is in custody since 24.08.2020.

Regard being had to the afore-stated facts and taking into account that the petitioner has no criminal antecedents, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge - cum - Special Judge, Nawada, in connection with Govindpur P. S. Case No. 174 of 2020.

The petition stands allowed.
