====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-07-2025 Heard learned counsel appearing on behalf of the petitioners and learned APP appearing on behalf of the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 149, 307, 337 and 506 of the Indian Penal Code.
3. As per prosecution case, all the 21 F.I.R. named accused persons including these petitioners and 8 to 10 unknown accused persons accosted son of the informant and pelted stone on him causing him injuries.
4. It is submitted by learned counsel appearing on behalf of the petitioners that allegation of pelting stone is general and omnibus and no specific overt act has been alleged
Patna High Court CR. MISC. No.39403 of 2025(2) dt.25-07-2025 2/2 against these petitioners. F.I.R. has been lodged after delay of two days without any explanation which renders the entire prosecution case doubtful. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the aforesaid facts of the case, prayer for bail of the petitioners is allowed. In the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Suryagadha P.S. Case No. 72 of 2024, subject to conditions as laid down under Section 482(2) of the B.N.S.S..
