JUSTICE RAKESH KUMAR ORAL ORDER 17-10-2016 Heard Sri Mrityunjay Prasad Singh, learned counsel for the petitioner and Sri Satya Nand Shukla, learned Additional Public Prosecutor.

The sole petitioner, who is in custody since 14.8.2016 in Sohsarai P.S. Case No. 144 of 2016, registered for the offence under Section 47 of the Bihar Excise Amendment Act 2016, has prayed for grant of bail.

By way of referring to the F.I.R. learned counsel for the petitioner submits that petitioner's name has come on disclosure made by the accused from whose possession huge quantity of foreign liquor was recovered. He further submits that petitioner is having clean antecedent and this fact has been

Patna High Court Cr.Misc. No.42988 of 2016 (2) dt.17-10-2016 2/2 mentioned in paragraph no. 3 of the petition. Sri Shukla, learned Additional Public Prosecutor has vehemently opposed the prayer for bail.

However, keeping in view the nature of accusation, clean antecedent as well as the fact that petitioner's name has come on disclosure of the co- accused, there is no reason to further detain the petitioner.

Let the petitioner Amit Kumar @ Munna @ Bhanu Pratap Sagar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate III, Nalanda / concerned court in connection with Sohsarai P.S. Case No. 144 of 2016.
