29-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Dumariyaghat P.S. Case No. 203 of 2020, registered for the offence under Sections 302, 120B, 201 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, on 23.10.2020 at about 7:30 PM, son of the informant went sasural of his brother and stayed there at night and on the next day, his dead-body was recovered near a pool in the water of a field. The informant suspects that FIR named accused persons committed murder of his son and threw his dead-body.

It is submitted on behalf of petitioner that deceased is own brother-in-law of the petitioner and on the date of occurrence, the deceased had already returned from there.

Patna High Court CR. MISC. No.51402 of 2021(2) dt.29-11-2021 2/2 Petitioner has been made accused only on suspicion and there is no eye-witness of the occurrence. Petitioner has got clean antecedent and he is in custody since 25.01.2021. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist, Motihari, East Champaran in connection with Dumariyaghat P.S. Case No. 203 of 2020.
