JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 11-05-2016 This contempt application has been for non-compliance of order, dated 22.09.2008, passed in Cr. W.J.C. No. 332 of 2007. The petitioner filed Cr. W.J.C. No. 332 of 2007 for providing protection from the high handedness of the private respondents, who have been pressurizing and harassing him. It appears that number of cases have been filed against each other by both the parties. One such case filed against the petitioner is Kargahar P.S. Case No. 76 of 2006, under Section 395 and 397 I.P.C.
Learned counsel submits that a show-cause has been
Patna High Court MJC No.3878 of 2013 (4) dt.11-05-2016 2/2 filed by the opposite parties, in which they state that final report has been submitted in the aforesaid case.
Counsel for the petitioner submits that though the opposite parties state that final report has been submitted in the case, but, in fact, no final report has been received on the record of the case before the concerned Magistrate at Sasaram. Having regard to the facts and circumstances of the case, the contempt application is disposed of in the following terms: The S.P. Rohtas would call for a report from the Officer Incharge of Kargahar Police Station as to whether the final report in Kargahar P.S. Case No. 76 of 2006, has in fact been submitted or not. In case no final report is submitted, the S.P. Rohtas would take necessary action against the erring Officer forthwith and a report to the aforesaid effect would be communicated to this Court.
The contempt application is closed.
