The petitioner seeks bail in Uda-Kishunganj P.S. Case No.18 of 2020 registered under Section 392 of the Indian Penal Code.

The informant, an employee of Bandhan Bank, alleged that while he was returning after collecting money, the criminals intercepted his motorcycle and they snatched his bag containing Rs.72,750/- and other belongings such as mobile and key of the motorcycle. The accused persons started fleeing away. On chase, one Sidhu Kumar was apprehended. The name of the petitioner surfaced in the case on the confessional statement of Sidhu Kumar who was apprehended on the spot. The learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.37661 of 2020(2) dt.09-02-2021 2/2 petitioner has got one criminal antecedent but Sidhu Kumar has already been enlarged on bail vide order dated 12.10.2020 passed in Cr. Misc. No.19839 of 2020 after remaining in jail for about nine months. The petitioner also remained in jail for about eight months and nothing has been recovered from the possession of the petitioner.

Taking into consideration the facts that the accused who was apprehended on the spot while fleeing away has been granted bail and the name of the petitioner surfaced in the case on the confessional statement of the accused who was apprehended on the spot and petitioner has remained in jail for about eight months, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, UdaKishunganj, Madhepura in connection with Uda-Kishunganj P.S. Case No.18 of 2020.
