The petitioner is languishing in custody since 22.01.2016 in connection with Barhaiya P.S. Case No. 206/2015 (G.R. No. 1701/2015) for the offences instituted under Sections 302/34 of the IPC and 27 of the Arms Act.
The prosecution story, in brief, is that on 25.10.2015 the accused persons including the petitioner made indiscriminate firing causing death of the informant's brother, namely, Mohan Kumar.
Earlier the bail application of the petitioner was rejected vide Cr. Misc. No. 29610 of 2016 taking into account that the prosecution witnesses in paragraph no. 39 of the case diary had
Patna High Court Cr.Misc. No.21789 of 2017 (3) dt.12-07-2017 2/2 made specific allegation against this petitioner and against coaccused, namely, Tutu Singh who alleged to have fired upon the deceased causing his death. This is second attempt on behalf of the petitioner for grant of bail.
Considering the nature of crime committed by the accused persons and the allegations made against him, I am not inclined to grant bail to the petitioner. The same is rejected in Barhaiya P.S. Case No.206/2015, pending in the court of the learned A.C.J.M. Lakhisarai.
