JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302,201 and 120B of the Indian Penal Code.

On recovery of the dead body of the informant's son, the FIR was registered against four accused persons including the petitioner. It is alleged that the victim and one Ravi Pal had illicit relationship with the sister of the petitioner which caused annoyance to their family.

Admittedly, there was no eye witness to the occurrence though suspicion was raised after one month of recovery of the dead body one witness disclosed that he saw Ravi Pal near the dead body of the victim. There is counter version of the

Patna High Court Cr.Misc. No.28446 of 2015 (2) dt.24-07-2015 2/2 occurrence also. It is further submitted that co accused Anil Pal has been granted bail vide Cr. Misc. No. 34024 of 2014. Considering the suspicious nature of accusation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Banka in connection with Belhar P.S. Case No. 52 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bonds of the petitioner will be accepted on filing of an affidavit by the petitioner before the learned court below that he will regularly cooperate in the investigation. The said affidavit will be transmitted by the learned court below to the concerned I.O. Non cooperation in investigation by the petitioner will give liberty to prosecution to file application for cancellation of bail bond by learned court below.
