Petitioner, already in custody, seeks bail in connection with Rafiganj PS Case No.155 of 2017, registered under Sections 420 and 379 of the Indian Penal Code. Allegation in brief is that the ATM card of the informant was deceitly taken by the petitioner and later on Rs.30,000/- was withdrawn.

Learned counsel for the petitioner submits that the ATM card of the informant has not been recovered from possession of the petitioner. However, learned counsel for the State concedes that though there is seizure list showing the ATM card recovered at the police station but it is not mentioned that wherefrom and from whose possession of the recovery was

Having considered the aforesaid facts and circumstances, petitioner Shankar Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Rafiganj PS Case No.155 of 2017.
