2. The petitioner is apprehending his arrest in a case in connection with Chanpatiya P.S. Case No. 245 of 2024 dated 23.12.2024 registered for the offence/s punishable u/ss 103(2), 80, 238, 61(2) of the Indian Penal Code.

3. As per the prosecution case, the co-accused persons are alleged to have strangulated the daughter of the informant to death and took her dead body in the car to conceal the same.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has no concern with the deceased or the alleged offence. The petitioner is not named in the FIR. The

Patna High Court CR. MISC. No.38544 of 2025(2) dt.22-08-2025 2/2 petitioner has been implicated in this case only because he is the owner of the said vehicle from which the dead body was recovered. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Bettiah, West Champaran in connection with Chanpatiya P.S. Case No. 245 of 2024, subject to conditions as laid down under section 482(2) of the BNSS.

7. The application stands allowed.
