Case No.527 of 2013 registered for the offences punishable under Sections 395 of the Indian Penal Code, the petitioners filed ABP No.1431 and 1495 of 2014 respectively before the Sessions Judge, Bhagalpur. The same were rejected on 29.08.2014. Hence, these applications for grant of anticipatory bail under
Patna High Court Cr.Misc. No.39646 of 2014 (2) dt.10-04-2015 2/2 Section 438 Cr. P.C.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Firstly, the names of the petitioners were not mentioned in the FIR, and secondly as against complaint that four or five persons committed the theft, as many as 12 persons were roped. This Court granted anticipatory bail to one of the accused in the same case in Cr. Misc. No.1857 of 2015 on 19.03.2014.
Hence, both these applications are allowed. In the event of arrest, the petitioners are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali P. S. Case No.527 of 2013. However, the petitioners shall appear before the concerned police station on 20th April, 2015 between 10 A.M. and 11 A.M. so that any information in relation to the crime can be elicited from the petitioners, but that would be without causing any detention.
