The petitioners apprehend their arrest in a case under section 304B and other sections of the Indian PenalCode. The father of the deceased disclosed that his daughter Murti Devi was married to Bhogi Sah alias Harendra Sah about six years ago, but her husband and other in-laws poisoned her to death.
It is submitted that the petitioners are mother-in-law and father-in-law of the deceased. The police after investigation submitted final form finding the case false against the petitioners,
Patna High Court Cr.Misc. No.50173 of 2014 (3) dt.10-04-2015 2 / 2 and the case was found true only against husband of the deceased and that too under section 306 of the Indian Penal Code. Considering the aforesaid facts, it is directed that in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, the above named petitioners shall be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka,in Katoriya P.S. Case No. 79 of 2012, subject to the conditions as laid down under section 438(2) Cr.P.C. (Prabhat Kumar Jha, J) B.Roy/- U
