The petitioner seeks bail in a case for the offence initially registered under Sections 307/34 of the Indian Penal Code & 27 of the Arms Act and later on, Section 302 of the Indian Penal Code was also added.

Allegedly, in course of making Tik Tok video, the nephew of the informant was shot as a result of which, the informant's nephew sustained bullet injury and died in course of treatment. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. The petitioner is in custody since 06-06-2020. Charge

Patna High Court CR. MISC. No.37764 of 2020(3) dt.23-03-2021 2/2 sheet/Prosecution report in this case has already been submitted. The main allegation of firing upon the deceased is against coaccused Dharam. There is no allegation of assault against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Nawada P.S. Case No. 336 of 2020.
