Petitioners seek regular bail in connection with Bikramganj P.S. Case No. 90 of 2021 registered for the offences

Patna High Court CR. MISC. No.49934 of 2021(2) dt.25-03-2022 2/3 punishable under Sections 429, 153(A), 295(A)/34 of the Indian Penal Code 1860, Section 11 of the Animals Cruelty Act, 1960 and Section 345 (R) (W) and 429 of Bihar Municipal Act, 2007. The Police intercepted a truck owned by one Sarfaraz Khan and recovered some quantity of beef from the truck and the owner of the truck was succeeded in fleeing away. Learned counsel for the petitioners submits that the petitioners have got no criminal antecedents and they are neither the owner nor the driver of the truck which would be evident from the First Information Report itself. Learned counsel further submits that in fact the petitioners had taken lift from the said truck in order to reach their destination and they were not aware about the beef being kept therein.

He next submits that from perusal of the First Information Report it is evident that the beef which has allegedly been recovered, was not the cow beef inasmuch as in the seizure list it has been described as beef of the family of the cow. He also submits that the petitioner is in custody since 22.03.2021 and charge sheet has already been submitted.

Regards being had to the submission made by the parties and taking into consideration the materials on record and the fact that the petitioners are in custody since 22.03.2021

Patna High Court CR. MISC. No.49934 of 2021(2) dt.25-03-2022 3/3 having no criminal antecedent, charge sheet has already been submitted and there is no likelihood that the petitioners will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioners.

Accordingly, let the petitioners, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas, in connection with Bikramganj P.S. Case No. 90 of 2021.
