ANJANA MISHRA ORAL ORDER 21-07-2015 Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners are apprehending their arrest in connection with Katoria P.S. Case No.188 of 2011 for allegedly having committed the offences under Sections 147, 148, 149, 341, 323, 324, 325, 307 and 302 of the Indian Penal Code. Learned counsel for the petitioners submits though the petitioners are named in the F.I.R., they can at best be said to be the members of unlawful assembly. It is further submitted that a perusal of the F.I.R. itself reveals that no specific role has been assigned to the petitioners. It is further submitted that the petitioners have no criminal antecedents and their names have been included in the said occurrence on account of village politics.

No.27457 of 2015 (2) dt.21-07-2015 2/2 Considering the aforementioned submissions and also the fact that the petitioners have no criminal antecedents, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Katoria P.S. Case No.188 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
