Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Section 420, 467, 468, 474 and 120B of the Indian Penal Code, registered in connection with Obra P.S.Case No. 61 of 2021.

As per allegation, some persons were issuing forged Pollution Under Control certificate of vehicles on NH-139. When the police raided the place of occurrence, co-accused Nitesh Kumar @ Nepali was apprehended. Two receipts, two stamps, one ink pad, one red colour sticker tape and Rs. 12,000/- cash were recovered from his possession. He disclosed the names of co-accused Sonu Kumar, Sukhadi, Biru, Guddu Singh and the present petitioner Dhananjay, who all fled away from the scene of occurrence.

The learned counsel for the petitioner has submitted that the name of the petitioner has figured in the confessional statement of co-accused. He was not arrested at the spot and he

She has submitted further that co-accused Biru, on similar footing, has been granted anticipatory bail by the learned court below itself. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Obra P.S.Case No. 61 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
