2. The petitioner seeks regular bail in connection with Muffasil P.S. Case No. 130 of 2025 registered for the offence under Sections 103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the petitioner and others alleged to have assaulted and killed the deceased due to non-fulfillment of demand of dowry.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 24.03.2025.
5. Learned A.P.P. appearing for the State as well as the
Patna High Court CR. MISC. No.41229 of 2025(2) dt.09-07-2025 2/2 learned counsel for the informant have vehemently opposed the prayer for bail.
6. From the perusal of the FIR, it appears that the deceased was taken to Rambha Hospital, Motihari where she was being treated and during the course of treatment, the deceased died. The petitioner is the husband of the deceased and the marriage was solemnized in the year 2015. Two children were born out of the wedlock.
7. Considering the facts and circumstances of the case as well as the fact that the deceased died in the hospital during the course of treatment, this application for regular bail is allowed.
8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari/concerned Court below in connection with Muffasil P.S. Case No. 130 of 2025.
