JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-02-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in connection with Bhaganwanpur P.S. Case No. 89 of 2016 registered under Sections 341,323,326,307,498A,504/34 of the Indian Penal Code pending in the Court of Sub-Divisional Judicial Magistrate, Kaimur at Bhabua.

It is alleged that the petitioners have killed the deceased by setting her on fire.

Learned counsel for the petitioner submits that the deceased died due to accidental death. Petitioners are separate in mess and residence from the husband of deceased. They are in jail

Patna High Court Cr.Misc. No.51403 of 2016 (4) dt.20-02-2017 since 10.07.2016.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioners with submission that the allegation is of serious in nature.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioners for bail. Accordingly, this application is rejected. However, petitioners may renew their prayer for bail after framing of charge.
