The petitioners apprehend their arrest in connection with Kurtha P.S. Case No. 112 of 2014 for the offences punishable under Sections 341, 323, 324, 307/504 of Indian Penal Code, Section 27 of the Arms Act and Sections 3(1)(x), 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act (hereinafter referred to as 'the S.C. & S.T. Act').
Mr. Paras Nath learned counsel for the petitioners with
Patna High Court Cr.Misc. No.45893 of 2014 (2) dt.10-04-2015 2 / 2 reference to the allegations set out in the F.I.R. submits that the allegations are omnibus in nature and there is no specific overt act attributed to any of the petitioners. He further submits that a plain reading of the allegations itself also reflect no offence made out under the provisions of S.C. & S.T. Act.
Having heard learned counsel for parties and taking note of the submissions of learned counsel, let the petitioners namely, (1) Sageer Ansari, (2) Nabab Ansari, (3) Fekan Shah, (4) Kayam Shah @ Klam Shah, (5) Bigan Shah, (6) Sharif Shah, (7) Chhotu Ansari, (8) Sahabuddin Ansari, (9) Zainu Ansari and (10) Khurshid Ansari in the event of their arrest/surrender within four weeks from today, be released on bail upon each of them furnishing individual bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Jehanabad in connection with Kurtha P.S.
