JUSTICE SANJAY PRIYA ORAL ORDER 24-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mairwa P.S. Case No. 76 of 2017 instituted for the offence under Sections-413, 414/34 of the Indian Penal Code.
As per written report, the police got information that accused Aditya Kumar Yadav had parked theft motorcycle. The informant found the parked motorcycle on verandah for which, on demand, he could not produce any valid paper. Thereafter, on the statement of Aditya Kumar Yadav, other motorcycles were also recovered from house of accused persons as mentioned in the written report. From the written report itself, it appears that there is no recovery from possession of the petitioner. The police has stated in the FIR that on arrest, this petitioner stated that he has purchased the motorcycle in question for a consideration of Rs.
Patna High Court Cr.Misc. No.24389 of 2017 (2) dt.24-05-2017 2/2 5,000/- The name of the petitioner came in confessional statement of the co-accused. The petitioner is in custody since 29-03-2017. In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mairwa P.S. Case No. 76 of 2017 to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Siwan subject to condition that both the bailors should be close relatives of the petitioner.
