The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 414 of the IPC and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is a case of recovery of about 350.17 liters of foreign liquor.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is no recovery from the conscious or constructive possession of the petitioner and the name of the petitioner has transpired by the confessional statement of co-

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri Pawan Kumar Pandey, Special Judge, Excise, Bettiah, West Champaran/concerned Court in connection with Shikarpur P.S. Case No. 210 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
