Petitioner, already in custody, seeks bail in connection with Muzaffarpur Town P.S. Case No.836 of 2017, registered under Sections 457, 380 and 411 of the Indian Penal Code. Allegation is that the petitioner in the evening was making an attempt to steal the motorcycle kept in the police station.

Learned counsel for the petitioner submits that in fact the petitioner was falsely implicated by the Home Guard because he is a sweeper and denied to clean the premises of the police station without any remuneration as per the dictate of the police officials and the petitioner has no criminal antecedent and has been in custody

Patna High Court Cr.Misc. No.27579 of 2018(5) dt.02-08-2018 2/2 since 12.11.2017.

However, the learned counsel for the State submits that he was caught red handed while committing theft from the premises of the police station.

Having considered the aforesaid facts and circumstances, petitioner Arjun Mallik is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Muzaffarpur Town P.S. Case No.836 of 2017 with condition that the petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
