JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-02-2021 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in a case registered for the offence punishable under Section 498A and other allied sections of the Indian Penal Code and sections 3⁄4 of the D.P. Act.
As per the prosecution case, the informant got married with co-accused Vikash Sahani two and a half years ago and
Patna High Court CR. MISC. No.6567 of 2021(2) dt.17-02-2021 2/3 after marriage she was blessed with one son. It is alleged that the petitioners and other family members started demanding dowry, snatched her one and a half years son and subjected her to torture and harassment and finally ousted her from the matrimonial house.
Learned counsel appearing for the petitioners submits that petitioner no.1 is father-in-law, petitioner no.2 is mother-inlaw and petitioners no.3 and 4 are married sisters-in-law (nanad) of the victim. Allegations are general and omnibus in nature. Petitioners no.1 and 2 live separately from the informant and her husband and have separate mess and business. Petitioners no. 3 and 4 are married nanad and they reside in their respective matrimonial house, as such, they have no concern with the informant and her husband and the specific allegation is against co-accused Vijay Sahani.
Considering the facts of the case, in the event of arrest/surrender within eight weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari in Harshidhi Police Station Case No. 07 of 2020/GR No.102 of 2020, subject to the conditions laid down
