JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 341, 423, 379, 504/34 of the Indian Penal Code and Section 3 (1) (x) SC/ST (POA) Act. It is alleged that petitioners along with three unknown persons surrounded the informant, assaulted him with fists and slaps, snatched his bicycle and abused him by calling his caste name.
It is submitted by the learned counsel for the petitioners that for the occurrence dated 13.11.2013 the FIR was registered on 14.11.2013 whereas the petitioners' side lodged Bakhri PS case No. 152 of 2013 on 12.07.2013 against the informant and others
Patna High Court Cr.Misc. No.28365 of 2015 (2) dt.23-07-2015 2/2 and witnesses of the present case are accused in that case. Considering the aforesaid facts and the fact that case lodged by the petitioners' side was at earlier point of time, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Deo Priya Kumar, learned JM, 1st class, Begusarai in connection with Bakhri P.S. Case No. 282 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
