JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-05-2018 The petitioner is apprehending his arrest in connection with Samastipur (Muffasil) P.S. Case No. 463 of 2017, registered for offences punishable under Sections 147, 341, 323, 379, 420, 447, 467, 468 and 34 of the Indian Penal Code. Allegation as per complaint petition that petitioner and one co-accused of this case had taken the tempo of the complainant/informant, with condition that he will giver her Rs. 5,000/- on monthly basis and also the installment of loan of the Bank and when they did not pay the installment of bank loan, informants/complainant went to aske, she was abused. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. Moreover, only Rs. 30,000/- is due which the petitioner is ready to deposit, if some

Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender before the court below along with a demand draft of Rs. 15,000/- payable to the complainant/informant and the court below after satisfying himself shall release the petitioner on provisional bail for a period of two months, during which period he will pay the remaining amount of Rs. 15,000/- through bank draft, thereafter, the bail bond of the petitioner shall be confirmed.

It is made clear that the amount so deposited by the petitioner shall be subject to the outcome of the case. (Vinod Kumar Sinha, J) sunil/- U T
