Petitioner seeks bail in a case registered for the offences punishable under Sections 120(B), 409, 420, 467, 468, 471 of the IPC & Sections 13(2) read with 13(1)(d) & 13(1)(c) of P.C.Act.
Petitioner was Assistant Branch Manager of the Indian Bank when the Srijan scandal took place whereunder the public money was misappropriated in collusion with different authorities including the Bank Authorities. Learned counsel for the petitioner submits that petitioner is in custody since 09.09.2019 and similarly situated some other co-accused persons have been allowed
Patna High Court CR. MISC. No.8635 of 2021(5) dt.13-08-2021 2/3 bail by this Court as well as Coordinate Bench of this Court vide orders at Annexure-5 considering grant of bail to Pankaj Kumar Jha by the Hon'ble Supreme Court in Cr.Appeal No.484 of 2020.
Mr. Bipin Kumar Sinha, learned counsel for the C.B.I. opposed the prayer for bail on the ground of material against the petitioner referred in the chargesheet. Considering the period already undergone by the petitioner and grant of bail to several other co-accused having identical allegation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Spl. Case No.04/2020 (RC 7/A/18) arising out of Bhagalpur, Kotwali (Tilka Manjhi) P.S.Case No.545 of 2017 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without
